This Privacy Policy explains how Frankly LLC, doing business as frankly ("frankly," "we," "us," or "our"), collects, uses, and shares personal information when you use the frankly mobile app and related services (the "Service"). frankly is a dating app currently available only in Austin, Texas, United States, on iOS and Android.

frankly is only for adults. You must be 18 or older to create an account or use the Service. The Service is not directed to, and we do not knowingly collect personal information from, anyone under 18. See Section 11, Children and minors.
We collect the following categories of personal information. We collect only what we need to run the Service.
If you sign in with Apple or Google, we receive a limited identifier (and, where you allow it, an email address — which may be Apple's private-relay address) from that provider to create and secure your account. Sign-in with Apple or Google is how we confirm you're a real person and deter bots. We follow Apple's and Google's rules for that data.
We use personal information to:

We keep personal information only as long as we need it for the purposes above, then delete or de-identify it. Some retention rules are firm product commitments:
We use Mixpanel for product analytics so we can understand how frankly is used in aggregate and make it better.
We deliberately keep personal identifiers out of analytics. We do not put any of the following into our analytics:
Where we measure things like message length or activity, we measure counts and patterns — not the underlying personal content. Analytics events are sent without your IP address.
We do not sell your data. We share personal information only with service providers ("sub-processors") who help us run the Service, and only as needed for them to do that work on our behalf, under contract. Our sub-processors include:

We may also disclose information when the law requires it (for example, in response to a valid legal request), to protect the safety of our users or the public, or as part of a business transfer (such as a merger or acquisition), in which case we will require the recipient to honor this policy or notify you as the law requires.
We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising. If this ever changes, we will update this policy and provide any opt-out the law requires before doing so.

To make a request you can't complete in the app, contact privacy@befrankly.app. We may need to verify your identity before acting on a request, and we will not discriminate against you for exercising your rights.
Depending on where you live, you may have additional rights under your state's privacy law — for example, the Texas Data Privacy and Security Act (TDPSA) for Texas residents and the California Consumer Privacy Act, as amended by the CPRA (CCPA), for California residents. We extend the following rights to all frankly users, regardless of state:
How to exercise your rights. Use the in-app controls where available, or email privacy@befrankly.app. You may use an authorized agent to submit a request on your behalf where the law allows; we may ask the agent for proof of authorization and may ask you to verify your identity. We will not discriminate against you for exercising these rights.
Sensitive information. Some information you provide (for example, data that may reveal sexual orientation) is treated as sensitive under some state laws. We process it only to provide the Service you ask for, consistent with this policy, and do not use it for advertising.
Timing and appeals. We will respond to a verifiable request within the period required by law (generally 45 days, extendable where permitted). If we deny your request, you may appeal by replying to our decision or emailing privacy@befrankly.app with "Appeal" in the subject line; we will respond to the appeal within the period the law requires. Texas residents who are unsatisfied with an appeal may contact the Texas Attorney General; California residents may have additional recourse under the CCPA.
frankly is for adults only. You must be 18 or older to use the Service. We do not knowingly collect personal information from anyone under 18. If we learn that someone under 18 has created an account, we will remove it. If you believe a minor is using frankly, please report the profile in the app or contact privacy@befrankly.app.
We use reasonable technical and organizational measures to protect personal information — for example, encryption in transit (HTTPS/TLS), access controls, and storing photos behind a content-delivery network with restricted access. No method of transmission or storage is perfectly secure, so we can't guarantee absolute security, but we work to protect your data and to respond quickly if something goes wrong. frankly is operated from the United States, and we host data in the United States. If you access the Service from outside the United States, you understand your information will be processed in the United States.
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate or required, notify you in the app. Your continued use of frankly after an update means you accept the revised policy.
